Dr. Mittleman will discuss the essential role IT procurement contracts serve in enabling the State to meet the needs of its citizen's and highlight the challenges faced in accomplishing this goal.

On August 23, 2005, Chapter 1 of the Laws of 2005 was signed by the Governor and became effective on January 1, 2006, it amended Article 1-A of the Legislative Law and Article 9 of the State Finance Law. These new laws became effective January 1, 2006 and its requirements materially alter how procurement are to be conducted in NYS. Speakers' presentations will focus on such matters as the specific requirements of the law, its impact on the private and public sectors, as well as, oversight and administrative compliance with the law.

This session will include an interactive panel of public and private sector experts who will share their experiences in undertaking major IT procurement; the challenges that confronted them, risk mitigation strategies employed and lessons learned and pitfalls to be avoided.

Ms. Zeronda's presentation will address such matters as: compromise positions which can protect the interests of both sides while protecting the business imperatives of both sides; public need to have an enterprise view, and private sector need to manage and contain risk; and "Best practice" discussion on material deviations, ownership and limitation of liability for IT procurements will be drawn from NYS and national efforts on these clauses and other concerns such as materials deviations

Session 4: Information Security Breach and Notification Act

Speaker: Mara Ginsberg, General Counsel, NYS Office of Cyber Security and Critical Infrastructure Coordination (CSCIC)
 
Chapter 442 of the laws of 2006 adds a new section 208 to the State Technology Law which deals with the protections of private information of NYS citizens. Ms. Ginsberg's presentation will focus on the requirements of this law and its impact on State entities.
